Welcome to Gawkc.com, owned by Inventa Solutions Inc. ("Inventa Solutions," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of the Gawkc.com website (the "Website") and all products and services offered, including but not limited to digital designs, templates, and digital books ("Products").

By accessing or using the Website, purchasing any Product, or creating an account, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, Refund Policy, and all other policies and disclaimers posted on the Website. If you do not agree to these Terms, please do not use our Website or purchase our Products.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you and Inventa Solutions Inc. You represent and warrant that you are at least 18 years old or are visiting the Website under the supervision of a parent or legal guardian.

4. Digital Product Sales (Including ebooks/eBooks)

• Product Descriptions: We strive to be as accurate as possible in our product descriptions, including specifications, compatibility, and file formats for digital products. However, we do not warrant that product descriptions or other content on this Website are entirely accurate, complete, reliable, current, or error-free.

• Pricing: All prices are subject to change without notice. We reserve the right to modify or discontinue any Product at any time without notice.

• Order Acceptance: We reserve the right to refuse or cancel any order for any reason, including limitations on quantities available for purchase, inaccuracies or errors in product or pricing information, or problems identified by our fraud prevention department.

• Payment: All payments are processed securely through third-party payment processors. Gawkc.com and Inventa Solutions Inc. do not store your full payment card information.

• Digital Delivery: Upon successful payment, digital products, including ebooks/eBooks, will typically be made available for download immediately through a link provided on the order confirmation page and/or sent to your registered email address. It is your responsibility to ensure you have the necessary software and devices to access and use the digital product in its provided format (e.g., ePub, PDF for eBooks). We are not responsible for compatibility issues arising from your specific device or software configurations.

• Licensing of Digital Products (ebooks/eBooks):

  • When you purchase an iBook or other digital product from Gawkc.com, you are granted a limited, non-exclusive, non-transferable, revocable license to access and use the digital product for your personal, non-commercial use only.

  • This license does not grant you ownership of the digital product or its intellectual property.

  • You may not reproduce, distribute, publicly display, perform, transmit, sell, resell, or otherwise exploit any part of the digital product without explicit written permission from Inventa Solutions Inc.

  • You may not modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on the digital product.

  • You may not share, lend, rent, sublicense, or otherwise provide access to the digital product to any other person, regardless of commercial or non-commercial intent

  • Any unauthorized use of the digital product constitutes a breach of these Terms and may violate copyright and other intellectual property laws, potentially leading to legal action.

• No Physical Delivery for Digital Products: Please note that ebooks and other digital products are delivered electronically and no physical copies will be shipped.

• Refunds for Digital Products: Due to the nature of digital goods, all sales of digital products, including ebooks/eBooks, are final and non-refundable once downloaded or accessed, except in cases where the product is proven to be defective or there is a wrong charge confirmed by our support team and cannot be rectified. Please refer to our separate Refund Policy for more details.

5. User Accounts

• Account Creation: You may be required to create an account to access certain features of the Website. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

• Account Security: You are responsible for maintaining the confidentiality of your account login information and are fully responsible for all activities that occur under your account. You agree to notify Gawkc.com and Inventa Solutions Inc. immediately of any unauthorized use of your account.

• Account Termination: We reserve the right to suspend or terminate your account at our sole discretion, without notice, for any reason, including but not limited to a breach of these Terms.

We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that Inventa Solutions Inc. shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

THE WEBSITE AND ALL PRODUCTS AND SERVICES DELIVERED TO YOU THROUGH THE WEBSITE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY REPRESENTATION, WARRANTIES, OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT.

BY USING GAWKC.COM AND/OR PURCHASING ANY PRODUCTS, YOU EXPRESSLY WAIVE ANY AND ALL CLAIMS, DEMANDS, ACTIONS, OR CAUSES OF ACTION OF ANY KIND AGAINST INVENTA SOLUTIONS INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS, ARISING FROM OR RELATED TO YOUR USE OF THE WEBSITE, THE PRODUCTS, OR ANY INTERACTIONS WITH INVENTA SOLUTIONS INC., WHETHER KNOWN OR UNKNOWN, INCLUDING BUT NOT LIMITED TO CLAIMS FOR NEGLIGENCE, BREACH OF CONTRACT, OR BREACH OF WARRANTY, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW. This waiver does not apply to claims arising from our gross negligence or willful misconduct, or where such waivers are prohibited by law.

You agree to indemnify, defend, and hold harmless Inventa Solutions Inc. and our parents, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third-party due to or arising out of your breach of these Terms or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

10. Severability

In the event that any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms, such determination shall not affect the validity and enforceability of any other remaining provisions.
